Membership Agreement

Membership & Billing   Monthly Membership Fees are billed on or around the 5th of each month and cover the period from the 5th through the 4th. The first month’s fee is prorated based on the date of enrollment. By joining, the Member authorizes Draza Martial Arts and its third‑party processor to securely store and charge the designated payment method for all fees. After enrollment, the Member will receive an email to create a secure payment account.   Club Enhancement Fee   A $65 annual Club Enhancement Fee will be billed to the Member’s designated account on October 17th each year.   Late Fees   If any attempt to collect the Monthly Membership Fee or Club Enhancement Fee is unsuccessful, a $15 late fee will be charged. Draza Martial Arts is not responsible for any fees charged by the Member’s financial institution.   Cancellation   Membership may be cancelled at any time. To avoid the next automatic charge on the 5th, cancellation notice should be provided by the 1st of the month. Charges incurred due to late notification remain the Member’s responsibility. Billing stops on the next full billing cycle beginning on the 5th after cancellation.   Freeze Policy   Membership may be frozen at any time for reasonable cause. Freezes longer than six months are treated as cancellations. Freeze requests follow the same notification deadline as cancellations.   Facility Use   Membership includes access to scheduled classes, open mat sessions, seminars, workshops, and additional training time outside scheduled classes with Head Coach approval. By signing, the Member affirms they are eighteen or older, physically able to participate, and responsible for proper use of the facility, equipment, and any guests they bring.   Rules & Regulations   The Member agrees to follow all rules issued verbally, posted in the facility, or provided electronically. Draza Martial Arts may amend rules at its discretion. Failure to comply may result in suspension or revocation of membership.   Assumption of Risk   Martial arts training involves inherent risks, including injury, disability, death, and property damage. Training may not always be supervised, and medical services may not be available. The Member voluntarily assumes all risks associated with participation and facility use.   COVID‑19   The Member agrees not to attend the facility if experiencing symptoms or after recent exposure to COVID‑19. The Member voluntarily assumes all risks of COVID‑19 exposure or infection.   Release of Liability   The Member, on behalf of themselves and their heirs, fully and forever releases Draza Martial Arts and its owners, employees, and agents from any and all claims related to injury, illness, disability, death, property damage, or COVID‑19 exposure arising from participation or presence at the facility, whether caused by negligence or otherwise.   Covenant Not to Sue   The Member agrees not to initiate or assist in any claim or lawsuit against Draza Martial Arts or its representatives for any injury, illness, death, or property damage connected to participation or facility use.   Indemnification   The Member agrees to defend and indemnify Draza Martial Arts against any third‑party claims, damages, or expenses arising from the Member’s actions, participation, or guests.   Personal Property   The Member is solely responsible for personal belongings and those of their guests. Draza Martial Arts is not responsible for lost, stolen, or damaged property. The Member is responsible for any damage they or their guests cause to the facility or equipment.   No Representations   The Member accepts the facility and equipment “AS IS.” No verbal statements or promises outside this Agreement are binding.   Acknowledgment & Acceptance   By signing, the Member confirms they have read, understand, and agree to all terms of this Membership Agreement and Liability Waiver and enter into it voluntarily.
